Welcome to martinvorel.com. This website presents the photographic work of Martin Vorel, an independent fine art photographer based in Prague, Czech Republic.
These Terms of Use explain the conditions for accessing and using this website, viewing and sharing its content, and following links to third-party services used for the production and sale of selected photography prints.
By using this website, you agree to these Terms of Use. If you do not agree with them, please do not use the website.
1. About This Website
Martinvorel.com is the official photography website of Martin Vorel. It contains fine art photography, photographic series, articles, information about the artist, and photographs available as prints.
The website is operated independently by Martin Vorel. It is not owned or operated by Fine Art America or Pixels.
Fine Art America and Pixels are third-party services that I use for the production, fulfilment, checkout, and delivery of many of my open-edition photography prints. Where a purchase is completed through one of those platforms, their own terms and policies apply to that transaction.

2. Copyright and Ownership of Photographs
Unless explicitly stated otherwise, all photographs displayed on martinvorel.com are original works created by Martin Vorel and are protected by applicable copyright laws.
Copyright remains with Martin Vorel even when a physical photography print is purchased.
Purchasing a print gives you ownership of the physical object you purchased. It does not transfer copyright, reproduction rights, commercial usage rights, digital distribution rights, or any other intellectual property rights in the underlying photograph.
You may display a purchased print for personal or other lawful purposes associated with ownership of the physical artwork, but you may not reproduce the image, manufacture copies, distribute digital versions, create derivative commercial products, or license the photograph to others without prior written permission.
3. Permitted Use of This Website
You may browse martinvorel.com and share links to its publicly accessible pages for personal, editorial, educational, or other lawful purposes.
Reasonable quotation from written content is permitted where allowed by law, provided that Martin Vorel and martinvorel.com are clearly credited and a link to the original page is included where appropriate.
Images may not be copied, downloaded, reproduced, republished, modified, redistributed, sold, licensed, or used commercially unless such use is expressly permitted on the relevant page or separately authorized in writing.
4. Photography Licensing
The availability of a photograph as a fine art print does not mean that the photograph is available for commercial reproduction or licensing.
If you are interested in using one of my photographs for a publication, website, book, editorial project, commercial project, exhibition, or another purpose, please contact me before using the image.
Any license is valid only when its scope and terms have been agreed explicitly.
Please note that some photographs published separately on Libreshot.com may be offered under different licensing conditions. The license stated on Libreshot applies only to the particular images made available there and does not automatically apply to photographs published on martinvorel.com.
5. Automated Use, AI Training and Data Extraction
Unless expressly permitted by law or authorized by me in writing, photographs and other original creative content from martinvorel.com may not be collected or reproduced for the purpose of creating commercial image datasets, training or fine-tuning generative artificial intelligence systems, producing synthetic derivatives, or building image libraries intended for redistribution.
Automated access that places an unreasonable load on the website, attempts to circumvent technical restrictions, or systematically downloads substantial amounts of copyrighted content is prohibited.
Normal indexing by legitimate search engines and services that direct users to the original website is not intended to be restricted by this provision.
6. Open-Edition Photography Prints
Most open-edition photography prints displayed on martinvorel.com are produced and sold using Pixels / Fine Art America.
When you select an open-edition photograph and choose to configure or purchase a print, you may be redirected to an external Pixels or Fine Art America website to select the size, print material, frame, mat, and other options and to complete your purchase.
When the checkout and payment take place on Pixels or Fine Art America, your purchase is a transaction processed through that third-party platform and is governed by its current terms, payment conditions, shipping conditions, privacy practices, and return policy.
You should review the applicable third-party conditions before completing your order:
Information on martinvorel.com about available sizes, materials, prices, production times, shipping, or framing is provided to help you understand the available options. The information displayed during the actual third-party checkout takes precedence if there is any difference.
7. Limited Editions and Direct Sales
Selected photographs may also be offered directly by Martin Vorel as signed and numbered limited editions or through another individually agreed form of direct sale.
These works are separate from the open-edition products fulfilled through Pixels / Fine Art America.
Where a purchase is made directly from Martin Vorel, the relevant price, edition details, payment method, shipping conditions, availability, and any other conditions applicable to the particular artwork will be communicated before the purchase is completed.
No provision in these Terms is intended to remove or restrict any mandatory consumer rights that apply under applicable law.

8. Prices and Product Availability
I make reasonable efforts to keep information about photographs, products, materials, and purchasing options accurate and up to date.
However, print sizes, materials, framing options, prices, production times, shipping methods, discounts, and product availability offered by third-party fulfilment providers may change without prior notice.
The final product configuration and price shown during checkout on the platform processing the transaction are authoritative for that order.
Displaying a photograph or product on martinvorel.com does not guarantee that every previously available size, material, or framing option will continue to be available indefinitely.
9. Shipping and Delivery
Open-edition print orders completed through Pixels / Fine Art America are produced and shipped by their fulfilment network.
Production and delivery times depend on the product, destination, selected shipping method, and other circumstances outside my direct control.

For orders placed through Pixels or Fine Art America, the shipping information and estimated delivery details displayed by the fulfilment provider during checkout take precedence.
10. Returns, Refunds and Damaged Orders
Returns and refunds for open-edition products purchased through Pixels / Fine Art America are handled according to the return policy applicable to that platform.
At the time of the latest update of these Terms, Pixels / Fine Art America provides a 30-day satisfaction guarantee for eligible purchases. Because third-party policies can change, please review their current policy when placing an order.

If your order was completed through Pixels / Fine Art America and arrives damaged, defective, or incorrect, the fulfilment provider responsible for the order should be contacted using the support information supplied with your purchase.
Conditions for artwork purchased directly from Martin Vorel may differ and will be communicated as part of the direct transaction, subject to any mandatory rights provided by applicable law.
11. Colour and Appearance of Prints
I make reasonable efforts to present photographs accurately on this website, but the appearance of an image on a screen may differ slightly from the appearance of a physical print.
Differences can result from monitor calibration, display technology, brightness settings, printing material, surface finish, print process, ambient light, and other factors.
Such normal differences between screen display and physical print do not mean that copyright or ownership of the image has changed or that the digital preview forms part of the purchased physical object.
12. Third-Party Websites and Services
Martinvorel.com contains links to third-party websites and services, including Pixels, Fine Art America, social networks, publications, and other external resources.
These websites are operated independently and may have their own terms, privacy policies, pricing, and business practices.
I am not responsible for the content, availability, security, privacy practices, or operation of third-party websites that I do not control.
A link from martinvorel.com to another website does not necessarily constitute an endorsement of everything published or offered on that website.
13. Accuracy of Information
I aim to provide accurate information about my photographs, the locations where they were created, photographic techniques, print options, and my artistic practice.
However, occasional errors, outdated information, typographical mistakes, or technical inaccuracies may occur.
I may correct or update website content at any time without prior notice.
If you notice an apparent factual error, you are welcome to contact me.
14. Website Availability
I aim to keep martinvorel.com accessible and functioning correctly, but uninterrupted availability cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, hosting issues, software updates, security measures, technical failures, or circumstances outside my reasonable control.
I may modify, reorganize, remove, or discontinue parts of the website when necessary.
15. Prohibited Use
You may not use martinvorel.com:

Except for limited rights necessary to browse and use the website normally, all rights not expressly granted remain reserved.

When you leave martinvorel.com and interact with Pixels, Fine Art America, or another third-party service, that service’s own privacy policy applies to the information you provide there.
18. Limitation of Responsibility
Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, I am not responsible for losses or disruption resulting from circumstances outside my reasonable control, including the operation of independent third-party websites, fulfilment providers, payment processors, shipping carriers, or internet infrastructure.
Where a product transaction is processed entirely by a third-party platform, claims concerning payment processing, manufacture, fulfilment, delivery, or returns may need to be resolved under that platform’s applicable terms and procedures.
19. Governing Law
These Terms of Use are governed by the laws applicable in the Czech Republic.
If you are a consumer, nothing in this provision deprives you of mandatory protections or rights that you may have under the laws applicable to you.

I may update these Terms of Use when the website, my services, applicable laws, or the third-party services used by the website change.
The latest version will be published on this page together with the date of the most recent update.
